California Privacy Policy

Introduction

The Gas Company, LLC dba Hawaii Gas (“Company”, “us” or “we”) is providing this California Privacy Notice (this “Notice”) pursuant to California law, including the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”).  This Notice supplements our Privacy Policy and applies solely to California residents, effective January 1, 2020.  Unless otherwise defined in this Notice or the Privacy Policy, initially-capitalized terms used in this Notice are defined in the CCPA. This Notice does not apply to non-California residents, or to Personal Information that we collect from employees, job applicants or contractors.

Personal Information Collected

Table A below describes the categories of Personal Information that we collect and have in the prior 12 months collected, and the purposes for which we collect such information.

1.    Identifiers, such as name, service and postal addresses, telephone number, unique account or personal identifier, online identifier, internet protocol (“IP”) address, email address, account name and other similar identifiers.

  • To provide services which are requested from us and to communicate with customers regarding the same.
  • To establish and maintain customer accounts, verify customer information, provide customer service, process invoices, payments and other transactions, to conduct service analytics, and other similar activities necessary for us to provide the requested services.
  • To prevent, detect and investigate security incidents that may compromise customers’ Personal Information.
  • To resist malicious, deceptive, fraudulent or illegal actions directed at the business and to prosecute those responsible for such actions.
  • To verify and maintain the quality of, and to improve, upgrade or enhance, the requested services, including through solicitations for responses to optional customer satisfaction surveys.
  • To comply with applicable law and legal processes.

2.    Personal information as defined in the California Customer Records law at California Civil Code (“CCC”) Section 1798.80, including name, social security number, address, telephone number, credit card or debit card number, payment history and other financial information.

3.    Characteristics of protected classifications under California or federal law, such as gender and date of birth (i.e., age).

4.    Commercial information, such as transaction information, financial details and payment history.

5.    Professional or employment-related information, such as job title and work history.

6.    Sensitive Personal Information such as social security number, driver’s license number, passport number or other government-issued identification number, account log-in and password.

7.    Internet or other electronic network activity information, such as browsing history, online behavior, interest data, and interactions with our and other websites, applications, systems and advertisements.

  • To verify and maintain the quality of, and to improve, upgrade or enhance, our services.
  • To provide non-personalized, non-targeted advertisements on our website, social media platforms and other third-party media.
  • To prevent, detect and investigate security incidents that may compromise customers’ Personal Information.
  • To comply with applicable law and legal processes.

8.    Geolocation data, such as device location and IP location.

  • To provide services which are requested from us at the precise location at which services are requested (commonly used for larger properties).

9.    Audio, electronic, visual, and similar information, such as call recordings, created in connection with our business activities.

  • To verify, maintain the quality of, and improve the services (including customer service) that we provide.

10.    Inferences drawn from any of the Personal Information listed above to create a profile or summary about a customer, for example, an individual’s preferences and characteristics.

  • To provide non-personalized, non-targeted advertisement on our website, social media platforms and other third-party media.
  • To verify and maintain the quality of, and to improve, upgrade or enhance, our services.

We do not use or disclose Personal Information to provide advertisements or marketing materials, unless and until a customer affirmatively subscribe to receive such materials.

Sources of Personal Information

We collect the Personal Information listed above from the following categories of sources:

Disclosure of Personal Information

We disclose, and in the past 12 months have disclosed, certain Personal Information described in Categories 1 through 6 in Table A above, for the corresponding purposes set forth in Table A, to the following third parties:

We do not use or disclose Sensitive Personal Information for purposes other than as set forth in Title 11, Division 6, Chapter 1, Article 3 of the California Code of Regulations, Section 7027, subsection (m) (“Section 7027, Subsection (m)”).

Sale or Sharing of Personal Information; Minors

We do not Sell or Share, and have not for the prior 12 months Sold or Shared, Personal Information within the scope of the application of the CCPA.  We do not knowingly collect, Sell or Share the Personal Information of consumers under 16 years of age.

For What Period Do We Retain Personal Information

The Company will retain information for as long as needed or permitted in light of the purpose(s) for which it was obtained. The criteria used to determine the Company’s retention periods include: (i) the reasonable expectations of the consumer concerning the purpose for which their Personal Information was collected, (ii) the type, nature and amount of Personal Information collected, (iii) disclosures to the consumer about the purpose for collecting or processing their Personal Information, (iv) the source of the Personal Information; (v) whether there is a legal obligation to which the Company is subject; (vi) whether retention is advisable in light of the Company’s legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations); and (vii) whether the consumer has requested that we delete their Personal Information.

Consumers’ Rights Under California Law

You have the following rights with respect to your Personal Information: 

Right to Know:  You have the right to know and request that we disclose to you the categories of Personal Information that we collect about you, the categories of sources from which your Personal Information is collected, the purpose for collecting, selling or sharing (as applicable) your Personal Information, the categories of third parties to whom we disclose Personal Information, and the specific pieces of Personal Information we have collected. 

Right to Deletion:  You have the right to request that we delete Personal Information we collected from you, subject to certain exceptions under California law that permit us to retain your Personal Information for certain purposes, including, to complete a transaction for which your Personal Information was collected, to detect security incidents and protect against malicious, deceptive or fraudulent activity, enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us, and to comply with a legal obligation.

Right to Correct:  You have the right to request that we correct inaccuracies in the Personal Information that we maintain.

Right to Opt Out of the Sale or Sharing of Personal Information:  You have the right to opt out of the Sale or Sharing of Personal Information by us. This right does not apply because we do not Sell or Share your Personal Information within the scope of the application of the CCPA.

Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to limit the certain uses of your Sensitive Personal Information.  This right does not apply to you because we do not use your Sensitive Personal Information for any purpose other than those set forth in Section 7027, Subsection (m). 

Right to Freedom from Discrimination: You have the right not to be discriminated against in pricing and services because you exercise any of the rights described above.

How to Exercise Your Rights

To exercise your rights under the CCPA, please fill out and submit an online Customer Request Form. You may also call our toll free number at (833) 875-8333 with your request. One of our agents will respond to your request, or if you leave a voicemail, will reply to you promptly to confirm your identity, confirm your request, and collect any additional information needed to respond to your request.

You may be required to provide proof of your identity, including, your full name, address, social security number, driver’s license and/or passport number.  Any Personal Information that you provide in connection with your exercise of rights will be used solely for the purpose of identity verification.

You may designate an authorized agent to make a request on your behalf if you provide us written authorization for that person to do so, and we can verify your and that person’s identity.  Please note that we may not be able to comply with your request if we are unable to confirm your identity or connect the information you provide with the Personal Information as it exists in our records. Also note that not all information we collect may be subject to all rights available to you under the CCPA.

Once we have verified your identity and request, we will process your request and advise you of the outcome.

Changes to This Notice

We may revise and update this Notice from time to time in our sole discretion with or without prior notice to you. You are ultimately responsible for reviewing this Notice from time to time to take notice of any changes we made, as they are binding on you. All revisions to this Notice will be effective upon publication. Your continued use of the Website following the publication of a revised Notice means that you accept and agree to the terms of the revised Notice.
